Distance Sales Agreement

This agreement is concluded electronically when you complete a payment for a VisaPhoto photo purchase, credit pack or membership.

Seller: Space Laika LLC, 30 N Gould St, STE R, Sheridan, WY 82801, USA, support@visaphoto.io, https://visaphoto.io. Buyer: the holder of the VisaPhoto account that places the order or, for an order placed without an account, the person who enters their e-mail address on the payment page. The buyer's contact address is the e-mail address registered to the account or entered on the payment page.
2. Subject
The sale and performance of the digital service ordered electronically by the buyer (a one-time photo purchase or credit pack, or a recurring membership), and the rights and obligations of the parties under Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation.
3. Service and price
The service, its main characteristics, the total price including taxes, the billing interval of a membership and the payment method are shown on the order screen and on the Stripe payment page before payment, and are listed in the Pre-Contract Information Form. A membership renews automatically at the chosen monthly or annual interval until cancelled. Prices are in US dollars; any currency conversion or bank fees are charged by your bank.
4. Payment
Payment is taken by card through Stripe. Card details are processed by Stripe and are not stored by the seller.
5. Performance
There is no physical delivery. After payment is confirmed, credits are added to the buyer's account immediately (normally within minutes) and can be used right away. Membership credits are added for each billing month. For a photo purchase, the files without the watermark of the chosen, already previewed photo become downloadable in the buyer's account immediately after payment is confirmed; the other photos of a family pack are added as credits. The files of a photo bought without an account can be downloaded on the same page immediately and are sent to the buyer's e-mail address.
6. Right of withdrawal
Under Article 15(1)(ğ) of the Distance Contracts Regulation, the right of withdrawal does not apply to services performed instantly in electronic form. Before payment, the buyer expressly requests immediate performance on the consent screen and acknowledges that the right of withdrawal ends once performance begins.
7. Refunds and cancellation
Payments are not refunded. If a photo generation fails, the credit used for it is restored to the buyer's balance. The buyer can cancel a membership at any time; it remains active until the end of the paid period and then does not renew. No partial refunds are made. Mandatory consumer rights are reserved.
8. Obligations
The seller provides the service as described in the Terms of Service. The buyer keeps the account credentials secure and uses the service lawfully. AI output and acceptance by an authority are not guaranteed, as described in the Terms of Service.
9. Disputes
For consumer transactions, complaints may be brought to the Consumer Arbitration Committee at the buyer's place of residence or where the transaction was made, within the monetary limits announced each year by the Ministry of Trade, and to Consumer Courts above those limits.
10. Acceptance and records
The buyer confirms on the consent screen, before payment, having read and accepted this agreement and the Pre-Contract Information Form. The agreement is concluded when payment is confirmed. The seller keeps the acceptance record (document version and time); the buyer can request a copy from support@visaphoto.io.
